We have spent over two years on the Homart case on our product CHANTELLE bio-placenta whoich has being misrepresented to consumers. On 6 July 2018, the Court has dismissed Homart’s appeal from the decision of Burley J dated in 20 April 2017.

Over the past decades, our CHANTELLE bio-placenta product has gained worldwide recognition and popularity especially in Asia. In 2016, Homart introduced their product CHERI bio-placenta with almost identical packaging however a completely different product formula. In reaction to this, our solicitor have sent a warning letter.

In response, without any efforts of contacting us, Homart started verbally attacking our company via social media and claimed that they have never heard from us. Shamelessly, they started court proceedings against us claiming we have fortified their CHERI bio-placenta.

Justice is served when the Federal Court ruled against Homart’s favour in 2017. Justice Burley ordered an injunction to Homart and pay our costs of the cross-claim as well as interlocutory steps to be taken to prepare for hearing regarding damages payable to Careline by Homart.

However the “copycat” showed no remorse in their actions, and appealed the Court’s decision. On 5 July 2018, the Court has dismissed the appeal. And ordered Homart to pay our cost of appeal. We will soon commence seeking damages from Homart.

The ruling of this case assures the integrity of competition. There is only one original Australian “golden box” bio-placenta: the CHANTELLE bio-placenta.

The act of forging our “golden box” CHANTELLE bio-product has led us to repackage our product in the colour of pink and modify all our marketing campaigns. As a result, we suffered huge losses. Due to quality strength of our bio-placenta product, the release of new packaging has also been much liked by consumers. Our newly packaged CHANTELLE bio-placenta is now referred by consumers as the “Chantelle Pink”.
